Communications

The entire communication with us is electronic. Every time you send us an email or visit our website, you are going to be communicating with us. You hereby consent to receive communications from us. You also agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the legal requirements that such communications be in writing.

Applicable Law

By visiting this website, you agree that the laws of the New Jersey, without regard to principles of conflict laws, will govern these terms of service, or any dispute of any sort that might come between Allstate Mapping & Layout LLC and you, or its business partners and associates.

Technical Assumptions - Land Surveying

  1. The survey shall be prepared in accordance with the current Code of Practice of the New Jersey State Board of Professional Engineers and Land Surveyors (NJSBPELS) or of the New York State Board for Engineering, Land Surveying and Geology (NYS Board), whichever is applicable.

  2. No special equipment is required beyond what is necessary to perform a conventional urban Land Survey.

  3. The site is accessible without cost for our crew to perform conventional land surveying operations between the hours of 8:00am and 5:00pm Monday to Friday.

  4. Surface appurtenances of underground utilities will not be field located.

  5. No costs for Hydrological Data, Environmental Data or Wetland determination / delineation are included herein. Large (12”+) Trees shall be field located, however only outlines of dense areas of trees will be shown without locating individual trees. All identification of tree species, condition, etc., shall be done by others.

  6. The Client shall provide a copy of the deed(s) transferring title to the current owners. Said report shall be the sole means of ascertaining easements, exceptions, reversions, etc., for the subject properties and a note stating this fact shall appear on any surveys we prepare.

  7. Final deliverables shall include three (5) copies in addition to a digital file in AutoCAD/PDF format.

  8. Additional services, if required, shall be requested in writing to AML and written confirmation transmitted to us prior to any additional work being performed.

  9. Work can commence upon written authorization and 65% retainer from you and our acknowledgement with final deliverables due two (2) weeks thereafter; weather and Holidays permitting. The remaining 35% will be due once final deliverables have been mailed.

  10. Visa, Discover, American Express, and MasterCard credit cards will be accepted. Credit Card transactions will assess a 3% nonrefundable convenience fee. Payments can also be made via cash or check without assessment of any fees. Please make checks payable to “Allstate Mapping & Layout”

  11. Work shall be stopped for reason of delinquent payment with no consequences to AML and the BUYER shall pay any costs for recovery of delinquent payments. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association.

  12. These Technical Assumptions shall become of any contractual agreement, purchase order or other written agreement between Allstate Mapping & Layout LLC and you.

Technical Assumptions - Heavy Construction

  1. We assume the following shall be contractual obligations between our firms:

  2. AML can submit certified payroll reports provided it is requested by a government agency.

  3. This document shall become a part of any contractual agreement between our firms.

  4. Retainage shall not be withheld from payments to AML.

  5. Billing shall be done every two (2) weeks. Payment terms shall be net fourteen (14) days.

  6. Late payments shall be charged at two (2%) percent per month compounded monthly, however this shall not prevent AML from taking any other action(s).

  7. Work shall be stopped for reason of delinquent payment with no consequences to AML and the CONTRACTOR shall pay any costs for recovery of delinquent payments.

  8. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association. In any action incurred to enforce this contract or defend services provided according to the contract, the prevailing party shall be entitled to reasonable attorney’s fees & costs.

  9. Field Reports, sketches, layout diagrams, etc., submitted by AML field personnel are subject to review / approval by a Licensed Land Surveyor at AML before any liability is incurred by us.

  10. The Contractor shall deliver to AML a complete set of approved current Architectural, Civil and Structural project plans at least one (1) week prior to requesting a field crew. CAD files are acceptable as supplemental information; however hard copies, i.e., prints are mandatory.

Insurance

A copy of our standard insurance coverages are available upon request and are assumed to be adequate.

Scheduling

Work can commence upon written authorization from you and our acknowledgement. We can normally provide a field crew within two (2) business days after notification by you.

Price Increases

All quoted rates shall remain in effect through June 30th after which there will be an automatic five (5%) percent increase across the board due to an existing collective bargaining agreement with IUOE-15D. Annually thereafter additional five (5%) percent increases across the board shall occur each successive July 1st. These escalators must be included in any Purchase Order or Sub-Contract.

Waiver and Direction Not to Set Corner Markers

This is to advise that I have been made aware of my right to have corner markers set as part of a survey to be performed on the aforementioned property. In addition, I have been made aware of the potential impact of signing the waiver Including: (1) the possible need for a future survey as a result of physical improvements to the property, such as a fence, addition, deck, pool, or shed, and (2) the potential Inability of the ultimate user to Identify the actual boundary of the property which could result In a boundary dispute with an adjoining property owner and/or property improvements not accurately situated on my property. The right to have corner markers set is hereby waived, and you are directed to perform the land survey without the setting of corner markers as provided by the regulations (N.J.AC. 13:40-5.2) of the State Board of Professional Engineers and Land Surveyors.

This waiver shall become of any contractual agreement, purchase order or other written agreement between Allstate Mapping & Layout LLC and you.

Disputes

Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by state or federal court New Jersey and you consent to exclusive jurisdiction and venue of such courts.

Comments, Reviews, and Emails

Visitors may post content as long as it is not obscene, illegal, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or injurious in any other way to third parties. Content has to be free of software viruses, political campaign, and commercial solicitation.
